SE RESUELVE:
ARTÍCULO PRIMERO.- DECLARAR FUNDADO EL RECURSO ADMINISTRATIVO DE
RECONSIDERACIÓN formulado por la Profesora BLANCA DELIA MEOÑO
HERRERA,
contra la
RESOLUCIÓN GERENCIAL REGIONAL
N°000477-2025-GR.LAMB/GRED [515499424-16] de fecha 26 DE MAYO DE
2025; consecuentemente, DECLARAR IMPROCEDENTE la PRETENSIÓN DE
NULIDAD DE OFICIO SOLICITADA POR LA UGEL CHICLAYO respecto a la
RESOLUCIÓN DIRECTORAL N°007473-2024-GR.LAMB/GRED-UGEL.CHIC
[515499424-2] de fecha 22 de noviembre de 2024, por haberse emitido de forma
congruente con la normatividad vigente, conforme a lo fundamentos expuestos en la
parte considerativa de la presente resolución.
ARTÍCULO SEGUNDO.- DECLARAR LA PLENA VALIDEZ Y EFICACIA de la
RESOLUCIÓN DIRECTORAL N°007473-2024-GR.LAMB/GRED-UGEL.CHIC
[515499424-2] de fecha 22 de noviembre de 2024; y ORDENAR el pleno cumplimiento
del acto administrativo contenido en ella; DEBIENDO la UGEL CHICLAYO,
EFECTIVIZAR EL PAGO DEL MONTO TOTAL POR CONCEPTO DE
COMPENSACIÓN POR TIEMPO DE SERVICIOS OTORGADO en esta; no
obstante, COMPLEMENTARLO con el correspondiente reintegro en caso se hubiere
efectivizado parcialmente atendiendo a la incoada RESOLUCIÓN GERENCIAL
REGIONAL N°000477-2025-GR.LAMB/GRED [515499424-16] de fecha 26 de mayo de
2025.
ARTÍCULO TERCERO.- DECLARAR EL AGOTAMIENTO DE LA VÍA
ADMINISTRATIVA, conforme a lo estipulado en el artículo 148° de la Constitución
concordante con el artículo 228° de la Ley 27444 – Ley del Procedimiento Administrativo
General.
ARTÍCULO CUARTO.- NOTIFICAR, el contenido de la presente resolución a la parte
interesada, de conformidad a lo establecido en el artículo 18° del TUO de la Ley
N°27444, Ley del Procedimiento Administrativo General, aprobado mediante Decreto
Supremo N°004-2019-JUS. -
